Terms of service

Last updated: 21 August 2026.

A. About these terms

These terms and conditions of use (the “Terms”) govern your access to and use of the website at https://elixi.com and its subpages (together, the “Site”). Please read them carefully.

These Terms govern use of the Site only. The Elixi mobile application for iOS and Android devices (the “Application”) and the services provided through it are governed by a separate document, the Elixi Terms and Conditions. Nothing in these Terms varies that document, and nothing in that document varies these Terms.

Where you submit a request or other information through the Site, additional terms apply - see Section D.

B. Who we are and how to contact us

The Site is operated by Elixi Ltd, a company registered in the Republic of Cyprus under company number HE 491665, with its registered office at Spyrou Kyprianou 50, IRIDA 3, 6th floor, 6057 Larnaca, Cyprus (“we”, “us” or “our”).

To contact us, email: support@elixi.com.

C. By using the site you accept these terms

By accessing or using the Site you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Site.

We recommend that you print or save a copy of these Terms for your records.

D. Other terms to apply

The following also apply to your use of the Site:

i.

our Data Privacy Policy, which explains how we handle personal data collected through the Site, including the information you give us when you ask for early access;

ii.

our Cookie Policy, which explains the cookies and similar technologies used on the Site;

iii.

our Recruitment and Engagement Privacy Notice, if you apply for a role with us;

iv.

our Consumer Health Data Privacy Policy, if you are a resident of Washington State or Nevada; and

v.

the terms and privacy notices of any third-party platform we use to receive submissions made through the Site.

Where you are directed to such a platform it is operated by a third party, and your use of it and the processing carried out there is governed by that platform’s own terms and privacy notice in addition to ours.

E. Important notice

The Site is not a medical product and does not provide medical advice, diagnosis or treatment. Information on the Site about health, wellness, biomarkers or the Application is provided for general information and wellness purposes only. It is not a substitute for the judgment of a qualified healthcare professional, and you must not rely on it when making health or medical decisions.

Descriptions of the Application on the Site are descriptions of a general wellness product. They are not claims that the Application diagnoses, prevents, monitors, treats or alleviates any disease or medical condition.

F. Who may use the site

The Application is intended for people aged 18 and over, and the Site is not directed to anyone under 18. If you are under 18, please do not submit any information to us through the Site.

You may not use the Site if you are located in, or ordinarily resident in, a country or territory subject to comprehensive economic or trade sanctions imposed by the United States, the European Union, the United Kingdom or the United Nations, or if you are a person designated on any applicable sanctions or restricted-parties list maintained by any of them.

G. We may change the terms

We may amend these Terms from time to time. Every time you use the Site you should check these Terms to understand those that apply at that time. Where a change is material we will take reasonable steps to bring it to your attention. The version in force is the one published on the Site when you use it.

H. We may change or withdraw the site

We may update and change the Site from time to time. Access to the Site is free of charge. Nothing is sold through the Site; subscriptions to the Application are purchased through the Apple App Store or Google Play and are governed by the Elixi Terms and Conditions and by the relevant store’s own terms.

We do not guarantee that the Site, or any content on it, will always be available or uninterrupted, and we may suspend, withdraw or restrict all or any part of it for operational reasons. We will try to give reasonable notice of any planned suspension.

You are responsible for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

I. Intellectual property rights

The Services, the Application and any content or information you obtain by using the Site may be protected by intellectual property rights, including, for example, patent, trademark, copyright, and database rights. All trademarks, service marks and logos used in the Site are owned by Elixi, its licensors, suppliers and other third parties. You may not use or display any trademarks, service marks, logos or designs used on our Site without prior written consent from the rightful owner(s).

J. Requesting early access

The Site allows you to ask us for early access to the Application by giving us your name and e-mail address.

Joining the waiting list does not create a contract between us, does not entitle you to receive the Application, and does not oblige us to release the Application at all, by any particular date, in any particular territory, or with any particular functionality. We may close the waiting list, change how it operates, or decide not to proceed, at any time.

Any early version of the Application made available to you may be a beta version provided for testing and evaluation, on an “as is” and “as available” basis. Its features may be restricted, modified or intermittently unavailable, and your use of it will be governed by the Elixi Terms and Conditions.

We use your name and e-mail address only to place you on the waiting list and to send you the download link and a limited number of related messages about the launch. Our Data Privacy Policy explains this in full, including how long we keep the respective information provided by you and how to withdraw your consent. You can unsubscribe from any messages we send you at any time.

K. Careers and job application

Where the Site advertises roles, you may apply for a role or send us a speculative application. Applications may be submitted through a recruitment platform we use, in which case that platform is operated by a third party and its own terms and privacy notice also apply.

A role advertised on the Site is an invitation to apply and is not an offer of employment or engagement. Submitting an application does not create any employment, worker, agency, partnership or contractual relationship between you and us, and does not oblige us to consider your application, to respond, to interview you, to fill the role, or to give reasons for any decision.

You warrant that the information in your application is accurate and not misleading, that you are entitled to work in the country in which the role is based or will obtain the necessary permission, and that by submitting it you do not breach any obligation you owe to a current or former employer, including any confidentiality or restrictive covenant.

We handle the personal data in your application in accordance with our Recruitment and Engagement Privacy Notice, which sets out the legal bases we rely on, how long we keep applications and who sees them.

L. Content you submit

This clause applies to information you submit through the Site other than a job application, which is dealt with in Section K.

You warrant that any content you submit is accurate, that you are entitled to submit it, and that it does not infringe the rights of any third party or breach any applicable law.

You must not submit any content that is unlawful, defamatory, obscene, offensive, misleading, discriminatory or threatening, that breaches anyone’s privacy or intellectual property rights, or that impersonates another person.

We may remove or refuse to accept any content that in our opinion does not comply with these Terms, and we may disclose your identity to any third party who claims that content you have submitted infringes their intellectual property or privacy rights.

M. Third-party platforms and links

We use third-party platforms and tools to receive and handle information submitted through the Site. Where they process personal data on our behalf they act as our processors under a written contract, and our Data Privacy Policy and Recruitment and Engagement Privacy Notice, explain how we use that data, who we share it with and the safeguards that apply. We are not responsible for the availability, performance or security of the platforms themselves, or for any act or omission of their operators outside the instructions we give them.

The Site may contain links to third-party websites, resources or articles, provided for information only. We have no control over them and accept no responsibility for their content or availability, and a link does not imply our endorsement.

N. Acceptable use

You may use the Site only for lawful purposes. You must not:

i.

misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;

ii.

attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it; or

iii.

attack the Site via a denial-of-service or distributed denial-of-service attack.

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your own information technology, computer programs and platform to access the Site, and you should use your own virus-protection software.

By breaching this clause you may commit a criminal offence under the law applicable to you. We will report any such breach to the relevant law-enforcement authorities and may co-operate with them by disclosing your identity. Your right to use the Site will cease immediately.

O. General information on the site

Content on the Site, including information about us, the Application, our Services and any opportunities is provided for general information only and is subject to change. It does not constitute an offer, a promise of engagement, or advice on which you should rely. While we make reasonable efforts to keep the Site up to date, we make no representations, warranties or guarantees that its content is accurate, complete or current.

P. Our responsibility for loss or damage suffered by you

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any liability that cannot lawfully be excluded or limited under the law that applies to you, including mandatory consumer protection law.

We provide the Site free of charge and for personal, non-commercial use. To the fullest extent permitted by applicable law, we will not be liable to you for loss of profits, loss of business, business interruption, loss of anticipated savings, loss of business opportunity, loss of goodwill or reputation, or any indirect or consequential loss, arising from your use of, or inability to use, the Site or from reliance on any content on it.

If you use the Site in the course of a business, we exclude all implied conditions, warranties, representations and other terms that may otherwise apply to the Site or its content, to the fullest extent permitted by law.

This clause does not apply to any claim covered by Section K, and does not affect our responsibilities as a controller of your personal data, which are set out in our Data Privacy Policy and cannot be limited by these Terms.

Q. Linking to the site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not suggest any form of association, approval or endorsement where none exists, and you must not frame the Site on any other site.

You must not establish a link from any website you do not own, and you must not link to any part of the Site other than its home page. We reserve the right to withdraw linking permission without notice. If you wish to make any other use of content on the Site, please contact us using the details in Section B.

R. Governing law and jurisdiction

These Terms, their subject matter and their formation are governed by the law of the Republic of Cyprus.

If you are a consumer resident in the European Economic Area or the United Kingdom, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country. We may bring proceedings against you only in the courts of your country of habitual residence.

If you are a resident of the United States, nothing in these Terms limits any right you have under the law of your state, and these Terms do not require you to arbitrate any claim. The arbitration and class-action waiver provisions in the Elixi Terms and Conditions apply to the Application and the services provided through it, and do not apply to your use of the Site.

In any other case, the courts of the Republic of Cyprus have exclusive jurisdiction, except where mandatory law gives you the right to bring proceedings elsewhere.

Section K takes precedence over this clause in relation to any recruitment or employment claim.

S. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of it.

These Terms are drawn up in English. Where we provide a translation, the English version prevails to the extent permitted by applicable law.
